If fully implemented, the Code has the potential to protect and\/or sequester over 100 GtCO<\/span><span style=\"font-weight: 400;\">2<\/span><span style=\"font-weight: 400;\">e, contributing to global climate systems and assisting Brazil in meeting its international climate target (NDC). Implementation of the law, however, has so far been poor and a real risk exists that this objective won\u2019t be achieved. There is a need to promote the implementation of the Forest Code and to provide incentives for landowners to comply with its requirements, creating positive social, economic, and environmental impacts. This is one of the objectives of the SIMFlor programme.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The SIMFlor Programme was conceived by <\/span><a href=\"http:\/\/bvrio.org\/\" target=\"_blank\" rel=\"noopener\"><b>BVRio<\/b><\/a><span style=\"font-weight: 400;\"> and the environmental finance firm <\/span><a href=\"https:\/\/sim.finance\/\" target=\"_blank\" rel=\"noopener\"><b>Sustainable Investment Management<\/b><\/a> <b>(SIM)<\/b><span style=\"font-weight: 400;\">, in partnership with climate mitigation project developer <\/span><a href=\"https:\/\/www.ecosecurities.com\/\" target=\"_blank\" rel=\"noopener\"><b>ecosecurities<\/b><\/a><b>.<\/b><span style=\"font-weight: 400;\">\u00a0The consortium raised a credit line from international carbon traders to acquire CRAs in Brazil and conserve forests from legal deforestation allowed in the country.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The programme aims to direct R$ 3 billion Reais for the implementation of the Forest Code, generating positive environmental impacts at scale.\u00a0SIMFlor has already secured R$ 1 billion to be allocated for the Brazilian Amazon, the focus of the initial phase of the programme. This will enable the conservation of 500,000 ha of native vegetation (of which, 100,000 ha of excess legal reserve that can be legally deforested) and store 300 Mt CO2 in these areas (of which 60 Mt CO2 in areas of excess legal reserves).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Providing that a landholding meets the Eligibility Criteria of the programme, any landowner can apply for participation in the programme. The main requirement is that landowners who sell the Forest Reserve Credits (CRAs) to SIMFlor commit to conserving their stocks of native forest for at least 30 years.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe SIMFlor Programme reinforces one of the main objectives of BVRio \u2013 the implementation of the Brazilian Forest Code, a law with transformational capacity for the Brazilian rural landscape\u201d, said <\/span><b>Mauricio Moura Costa, CEO of Instituto BVRio in Brazil. <\/b><span style=\"font-weight: 400;\">\u201cBVRio has been promoting implementation of the Forest Code since its promulgation in 2012, and this programme now allows us to kick-start the use of the Forest Reserve Credits mechanism that we promoted for so long,\u201d added <\/span><b>Beto Mesquita, Director of Instituto BVRio in Brazil<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe are pleased to announce this transformational programme, combining the dual objective of nature-based solutions and climate change mitigation with the national objective of implementing the Brazilian Forest Code. There is a need to promote the implementation of the Forest Code and to provide incentives for landowners to comply with its requirements, creating positive social, economic, and environmental impacts.<\/span><\/p>\n<p><b>Forest Legal Reserves<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Brazilian Forest Law requires that all rural landholdings in the country maintain a certain amount of land under native vegetation (called \u201cLegal Reserves\u201d \u2013 <\/span><i><span style=\"font-weight: 400;\">Reserva Legal<\/span><\/i><span style=\"font-weight: 400;\">, in Portuguese). The amount of legal reserve required varies depending on the biome, and amounts to 80% in the Amazon. Landowners that do not have sufficient area with native vegetation in their forest legal reserves, can comply with the law by acquiring Forest Reserve Credits.\u00a0<\/span><\/p>\n<p><b>Forest Reserve Credits\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;Forest Reserve Credits\u201d (or \u201cCRAs\u201d, from the name in Portuguese &#8211; <\/span><i><span style=\"font-weight: 400;\">Cotas de Reserva Ambiental<\/span><\/i><span style=\"font-weight: 400;\">) is a type of offset mechanism created by the Forest Code to enables landowners to comply with the legal reserve requirement through paying for the maintenance of existing forest areas outside their own lands. Although this is a potentially transformational approach, this aspect of the law has not yet been regulated and there is no system available to enable the use of this mechanism.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The SIMFlor programme aims to kick start the use of this mechanism by acquiring the rights to CRAs that will be issued in the future, creating an incentive to conserve natural forest, reduce deforestation and protect existing biodiversity.<\/span><\/p>\n<p><b>Cadastro Ambiental Rural (CAR)<\/b><\/p>\n<p><span style=\"font-weight: 400;\">With the support of the newly created Rural Environmental Registry system (<\/span><i><span style=\"font-weight: 400;\">Cadastro Ambiental Rural<\/span><\/i><span style=\"font-weight: 400;\"> \u2013 CAR), a georeferenced digital registry connected to satellite images that enables monitoring and mapping of land use in rural properties, the government will now be able to enforce compliance with this legislation and demand that rural producers fulfil their obligations.\u00a0 Registration in the CAR is a prerequisite for the creation of Forest Reserve Credits (CRAs) and for participation in the SIMFlor Programme.\u00a0 The programme also requires registration in the SIGEF system of INCRA (the National Institution of Agrarian Reform, that keeps a database of land ownership and tenure).\u00a0<\/span><\/p>\n<p><b>An urgent need to implement the Code\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The absence of financial incentives and\/or enforcement measures prevent the implementation of the Forest Code.\u00a0 This, in turn, is resulting in unprecedented levels of legal and illegal deforestation, as evidenced by the illegal forest fires of 2020 and 2021. There is an urgent need to ensure compliance with the Code, and the incentives provided by SIMFlor will contribute to this
